In this book is discussed basses of invoking responsibility of a state and individual criminal responsibility for crime of genocide. It is shown that these two regimes of responsibility are distinct and differ from each other, but it does not mean that they never overlap.In crime of genocide individual responsibility is essential, because this internationally wrongful act is committed by man and only attributing this act to the state can be invoked states responsibility. Based on the genocide case (Serbia v. Bosnia) before the ICJ it will be shown what kind of problems are related to the state responsibility for genocide. Main attention will be paid to the problems of attributing act of individuals to the state. Grounds for invoking state responsibility for genocide, which are in case law of ICTR and ICTY will prove that danger of replacing state responsibility by individual liability does not exist. The analysis will show that there should be paid more attention on state responsibility for Genocide.
